Waxup AI, hereinafter referred to as "the platform," was created to provide a virtual assistant powered by large language models and other generative, reviewing, and editing technologies, among others classified under the concept of artificial intelligence. As of this date, the assistant operates exclusively through WordPress and Shopify. If you wish to implement it on a different platform, please email us at contact@waxup.ai to inquire about future feasibility. The functionalities provided depend on the training and/or customization performed by you as a client/user. The information and content published on this page, provided for the aforementioned purpose, should not be considered exhaustive, complete, or guaranteed to meet all user needs.

The general Terms and Conditions outlined herein regulate the use of this website. Your use of the site constitutes acknowledgment as a Client/User, hereinafter referred to as "the user," and indicates express acceptance of all these Terms and Conditions without reservation. Therefore, you should carefully read these Terms and Conditions every time you plan to use or interact with the service provider.

It is also established that Waxup AI may modify these Terms and Conditions in whole or in part, and such changes will take effect as soon as they are published on this site or communicated to the user by any means, with precedence given to whichever occurs first. For this reason, users are encouraged to review these terms periodically.

DEFINITIONS

Client/User: Visitors, as well as individuals and/or companies contracting the services offered and provided by the platform. For those clients who are up-to-date on their payments and have active credits, the term applies equally to visitors and clients without active credits. Visitors will have access to limited content and information about the services available on the website. Clients/users will have access to the use and enjoyment of the platform's functionalities, as outlined in these terms and conditions.

Third Parties: Waxup AI is not a controlling beneficiary and does not exercise any direct or indirect control over the providers involved in delivering services to Clients/Users through the platform. Third parties perform key functions to optimize the experience and identify errors to improve the service. Therefore, integrations that enable the platform's functionality are declared as intellectual property, while third parties are recognized as auxiliary facilitators.

Website: Refers to access through waxup.ai, where services, content, paid access, and event scheduling are presented.

Dashboard: Refers to the interactive panel accessible to Clients/Users via their username and password, once they have registered an account.

Plans: Refers to the annual service offerings with distinct features based on their designation and advertised pricing. Visitors who subscribe to a plan become Clients/Users of the platform.

TERMS OF ACCESS AND USE OF THE WEBSITE AND DASHBOARD

The Client/User of this website and online platform agrees to use this page exclusively for lawful activities and to behave in accordance with the objectives, terms, and conditions established herein. Waxup AI uses APIs (integration interfaces) to deliver a user experience aligned with the advertised standards. Consequently, the user accepts that service interruptions beyond the platform's control may occur. The platform will make every effort to prevent these, utilizing its best knowledge and resources available at the time.

The Client/User agrees to use the platform lawfully and, in particular, undertakes to refrain from: (a) Using the platform in ways, for purposes, or with effects contrary to law, morality, commonly accepted good practices, or public order.

(b) Reproducing, copying, distributing, transforming, or modifying the platform in its form or substance.

(c) Using the platform to publish threatening, defamatory, libelous, obscene, pornographic, or otherwise illegal content.

LIMITATION OF LIABILITY

Waxup AI will not be held responsible for damages caused by using the information provided through the service. Furthermore, it does not guarantee the accuracy or reliability of the information on this site, its updates, or the possibility of alterations or modifications made in whole or in part after inclusion on the site. Waxup AI is not liable for the information or content used to train or customize the platform.

Waxup AI will not be responsible for damages caused by viruses, spyware, or other elements in the content that may affect users' computer systems, programs, electronic documents, files, or hardware.

For questions regarding the information presented on the website or any advertising, users have the right to email contact@waxup.ai to ensure full understanding of the offerings. Purchasing a plan is considered confirmation that you have read, understood, and agreed to these terms and conditions.

DATA PROTECTION FOR CLIENTS/USERS AND THEIR END USERS

The privacy policy regarding the handling of users’ personal data is detailed in the Privacy Notice section. This section also outlines methods for users to remove, modify, or review their personal data.

Third parties, particularly WordPress, by incorporating their plugins into the platform, require communication and message transfer between users and Clients/Users. These interactions remain anonymous, as does the IP address of the Clients/Users when using the platform.

INTELLECTUAL PROPERTY

The platform, including all graphic elements, code, trademarks, designs, code integrations, and functionalities, is protected by intellectual property laws. Copying, modifying, reproducing, downloading, transmitting, distributing, or transforming the platform without prior authorization is strictly prohibited.

While the platform may use generative tools within the category of Artificial Intelligence (AI), their contributions will be recognized where applicable, with credit given to the platform's owners for instructions or prompts used.

Access to the website does not grant ownership rights over the platform to the clients/users. Failure to credit the original publication of any content reproduced elsewhere constitutes a violation of the law.

SITE FUNCTIONALITY

Waxup AI may, at its discretion, make corrections, improvements, or modifications to the information on the website or platform without this giving rise to claims or indemnifications. It is also not responsible for damages arising from the technical availability or continuity of the website or platform.

REFUNDS

Clients/Users who have subscribed to a plan may request a full refund under the following conditions:

The request is made within 30 calendar days of purchase.
The request is emailed to contact@waxup.ai, including the purchaser's details, payment proof, and registered email. Refunds will not be issued to individuals other than the original payment method owner.
State the reason for the refund request to help improve services (this will not affect your eligibility for the refund).
If an invoice was issued, it will be canceled using the appropriate tax authority code.

Refunds will be processed within 20 banking business days. Confirmation will be sent, which serves as definitive proof of the refund. Any subsequent clarifications must be directed to your banking operator.

GOVERNING LAW AND JURISDICTION

All matters between the site and the user will be governed by the laws of the United Mexican States, excluding any law that refers to the application of foreign law.
